What is a Certified Legal Nurse Consultantcm(CLNC®)?
A CLNC® is a Registered Nurse who uses his or her existing understanding of healthcare combined with training from the Vickie Milazzo Institute to assist attorneys on all types of medically related cases.

What are Advance Directives?
A means to make your health care wishes known in the event that you are unable to make those decisions for yourself. It allows you to appoint a health care agent. Your health care agent is the person you name as the individual who will make healthcare decisions for you in the event you are unable to make them for yourself.
Your Health Care Agent makes decisions for you any time you are unable to make those decisions for yourself. This can include but is not limited too if you were under anesthesia or sedated for a medical procedure, or had an altered mental status, or you were in an accident.

Writing advance directives is about being prepared.
It is about making your wishes known both in writing and via a conversation with your Agent (The person you are appointing to make those decisions for you) as well as any and all family members who may want to be involved in your care if you were not able to make decisions for yourself. Having everyone on the same page makes it easy for all involved to make the right decision. The right decision is what decision you would make.
There are many decisions that should be discussed while drafting Advance Directives. Have New York Legal Nurse Consultants Inc. on your team. We are the team that understands first hand the tough choices that need to be made.

Usually an Advance Directive is composed of two parts
1) Appointing a person to speak for you on health care matters (An Agent). The document may be called a Durable Power of Attorney for Health Care.
2) A description of medical treatments you want (A Living Will or a Health Care Treatment Directive).
In New York State, a Health Care Proxy form can be utilized to identify the Agent (The person you appoint to make health care decisions for you), and you may use this form to direct your agent on medical treatments you would or would not like to have performed. It is suggested to fill out a Living Will form as well as the forms differ from state to state.

Advance Directives are not only about “Pulling the Plug.
If you are not able to make health care decisions even temporarily in the case of an accident, you are disoriented, or you are having surgery and are under anesthesia, someone else must make decisions for you. Appointing an Agent allows you to remain in control of what medical treatment you receive.
It is about being prepared.
Advance Directives are a form of insurance and assurance. They allow you to communicate your wishes to loved ones so they may act on your behalf

What is a Health Care Proxy?
A document that identifies who you would like to make your health care decisions in the event that you are not able to make them for yourself. You are able to control and limit this person’s authority. You may dictate specific instructions on this document. You may obtain a Health Care Proxy form from www.health.state.ny.us/forms/doh/1430.pdf

What is a Health Care Agent?
This is the person that you name on your health care proxy form.

A Health Care Proxy is the document.
The Health Care Agent (or the Agent) is the Person you identify on your health care proxy form to make healthcare decisions for you.

What Authority does Your Health Care Agents Have?
The person you appoint by listing them on your Health Care Proxy form can only make decisions once two doctors determine that you have lost the capacity to make decisions for yourself.
You have the choice to give this Agent as little or as much power to make your health care decisions as you wish. This is noted in limitations on the Health Care Proxy form.
It is important to communicate your wants and beliefs regarding artificial nutrition and hydration. You may do this verbally or by writing it on your health care proxy form.
Your Health Care Agent will have the authority to decide if you will receive cardiopulmonary resuscitation (CPR) unless you specify on the Health Care Proxy form that your agent cannot make this decision for you.
Once your Agent’s authority begins he or she has the right to obtain your medical records so that s/he may make informed decisions about your care.
Your Agent’s decision is final unless an objecting family member or facility obtains a court order overriding the decisions or disqualifying Agent.
Your Agent is not financially responsible for the cost of your care.
Overall your Agent is required to make decisions regarding your health care in accordance with your wishes, religious and moral beliefs and in your best interest.
